VIENNA (AP) - An Austrian court found eight Iraqi nationals guilty on Thursday of gang-raping a German tourist on New Year's Eve more than a year ago and sentenced them to prison terms of between nine and 13 years.
Charges against a ninth suspect were dismissed, said a court statement. The victim - a 28-year old woman - was awarded 25,000 euros (over $26,000) in damages.
Both sides were appealing the decision, the statement said.

The Iraqis, aged between 22 and 48, came to Austria as migrants between May and December 2015. Five subsequently were given refugee status.
The prosecution charged that the eight exploited the fact that the victim had been drinking heavily on New Year's Eve 2015 and was unable to defend herself.
The court heard testimony that four of the men took her to a Vienna apartment where they were joined by the others and that all took turns raping her. When she regained control, she found herself naked in a bed.
Prosecutor Karina Fehringer said the victim continues to suffer post-traumatic effects from the assault that required psychiatric treatment.
All but one of the defendants denied raping the woman while some acknowledged having what they described as voluntary sex with her. But Fehringer suggested that was impossible, describing the victim as being in defenseless in an "unconscious, shock-rigid" state.
Charges were dismissed against the 48-year old who said he had been asleep during the assaults.
Rape is punishable by a maximum 15-year prison term in Austria. Explaining the verdict and sentencing, Judge Petra Poschalko said that only two of the defendants had helped the court establish the facts and only one had confessed.
Fehringer had dismissed defense claims that the victim could have sent "false signals" that could have encouraged the men.
Noting that the woman had been heavily intoxicated, Fehringer was quoted by the Austria Press Agency as asking: "Should we stick warnings on bottles: 'excess consumption could be interpreted as agreement to have sex?'"
Defense lawyer Andreas Reichenbach observed that the crime was committed at around the same time as the high-profile sexual assaults in Cologne by groups of migrants and suggested the tough sentences might be an "additional message" that such actions will not be tolerated.

A German inventor has created rape-proof knickers in the wake of a spate of sex attacks.
The underwear comes equipped with a combination lock and a loud alarm which goes off if they are tampered with.
German media has reported the pants are so popular some online shops have sold out.
The wearer puts a combination lock on and if they are tampered with the alarm is triggered
The manufacturers say they are simple to use and give the wearer a sense of security
Because
of the lock, the pants cannot be pulled off and they are made with a
material which is almost impossible to cut through or tear.
The 130-decibel alarm is automatically activated if the garment is cut off.
The advertisement for the pants reads: 'Scarcely a day passes without headlines of sexual assaults.
'Only
recently, a father in Kleve could barely prevent an attempted rape of
his daughter. Brand new on the market of deterrence: underpants with a
number lock.'
But security comes with a price - one pair of the pants costs 100 euros (£87).
The 'safe
shorts' come in two different styles - the one on the left can be worn
under shorts or a short skirt, while the one on the right is designed to
go under trousers or a dress
There has been a mixed reaction to the 'safety shorts' on the Internet.
One
social media user in Germany wrote: 'The idea is good. One never knows
what is going on in these heads of the perpetrators. Yet honestly, it is
actually bad that one had to invent such a doubtlessly well-intentioned
thing.'
But another user claimed:
'What if the women are directly threatened with weapons and forced to
open the lock if the perpetrators do not succeed?'
When anti-rape underwear was first mooted
in America in 2013 feminist writer Louise Pennington described it as a
'modern chastity belt' and added: 'Let's focus on men preventing rape by
not raping rather than curtailing women's freedom to exist.'
Similar
safety devices, such as small alarm systems for handbags, have recently
gone on the market in Germany to protect women from possible attacks.
On
New Year's Eve 2015 celebrations in Cologne were marred by mass sex
attacks on women and last year and in October, Maria Ladenburger, 19,
was raped and murdered in the city of Freiburg.

Representatives of two indigenous groups have filed a class action suit in New York against Germany, seeking reparations for a genocide of their peoples by German colonial rulers over a century ago in what is now Namibia.
The suit filed by the Ovaherero and Nama people on Thursday in New York also demands that their representatives be included in negotiations between Germany and Namibia on the issue.
U.S. representatives of the German government did not immediately respond to requests for comment.
The slaughter took place from roughly 1904 to 1908, when Namibia was a German colony known as South-West Africa, after the Herero and Nama groups resisted German rule.
The two countries have been in talks about a joint declaration on the massacres, although Germany has repeatedly refused to acknowledge that a genocide occurred or to pay reparations.
The plaintiffs said they were bringing the class action suit "on behalf of all Ovaherero and Nama worldwide, seeking reparations and compensation for the genocide" suffered at the hands of the German colonial authorities.
They said they were also seeking a declaration of their right "to be included in any negotiation between Germany and Namibia" and that no settlements can be reached unless they are among the signatories.
The dispute harkens back to a period in the late 19th and early 20th century when South West Africa, now known as Namibia, was a German colony.
The suit claims that from 1885 to 1903 about a quarter of Ovaherero and Nama lands - thousands of square miles - was taken without compensation by German settlers with the explicit consent of German colonial authorities.
It also claims that German colonial authorities turned a blind eye to rapes by colonists of Ovaherero and Nama women and girls, and the use of forced labor.
Tensions boiled over in early 1904 when the Ovaherero rose up, followed by the Nama, in an insurrection crushed by German imperial troops.
The suit alleges that as many 100,000 Ovaherero and Nama people died in a campaign of annihilation led by German General Lothar von Trotha.
The plaintiffs include Vekuii Rukoro, identified as the paramount chief of the Ovaherero people, David Frederick, chief and chairman of the Nama Traditional Authorities Association, and the non-profit Association of the Ovaherero Genocide in the USA, Inc.

A dead pig with German Chancellor Angela Merkel’s name smeared onto it was found on the building site of a mosque in Leipzig, police said on Thursday.
An investigation has been launched into the matter and police said they are treating the act in the eastern German city as politically motivated.
The words “Mutti Merkel” were scrawled onto the carcass in red paint, police said. “Mutti” is the German word for “mum” and is often used to refer to the German leader.
Merkel has come up against scorn from right-wing, Islamophobic groups over her decision to allow 1.1 million migrants - many of them refugees fleeing war in the Middle East - into the country in 2015.
This is not the first time that the site in Leipzig has been targeted. In 2013, the severed heads of five pigs were found there after weeks of protests against the construction of the mosque, which will have minarets.
Leipzig is situated in the eastern state of Saxony, where a recent spike in xenophobic attacks against migrants and refugees has prompted concern at a national level.

The Environmental Institute in Munich conducted the tests on the 14 beers with the highest sales figures in Germany and found that all of them contained traces of the pesticide. The results showed that Hasseröder, a brewery in Saxony-Anhalt, had the highest intensity of the pesticide – with 29.74 microgrammes of the chemical per litre of beer. The lowest levels on the other hand were to be found in the Bavarian Augustiner beers, which had a comparatively low 0.46 microgrammes of the pesticide in every litre of its amber brew. But even this quantity is over four times the legal limit for drinking water which is set at 0.1 microgrammes per litre, Spiegel reports. Coming in the year of the much celebrated 500th anniversary of the famed Beer Purity Law, the results couldn’t be worse timed, and could tarnish German beer’s worldwide reputation for quality as well as taste. But the Association of German Brewers (BfR) denied on Thursday that the reported figures posed any risk to people’s health. While saying that it had not seen the results of the testing, the BfR claimed that the reported levels of the pesticide lie well below what is currently considered to pose a health risk. “For an adult to consume unhealthy amounts of Glyphosate, he would have to drink around 1,000 litres of beer a day,” the BfR said in a statement. “According to current scientific understanding, a Glyphosate level of 30 micrograms per litre doesn’t pose any health risk,” they continued. Fierce scientific debate Debate is currently raging among health experts as to whether Glyphosate, made by controversial American agrochemical giant Monsanto, is safe to use. In 2015, the World Health Organization (WHO) labelled Glyphosate “potentially carcinogenic.” But the EU food safety authority Efsa came to a different conclusion, announcing it was “unlikely that Glyphosate poses a cancer risk to humans” – a conclusion which some researchers described as “scientifically unacceptable.” With Monsanto’s licence to sell the pesticide running out in the summer, the European Commission will have to once again consider whether the product is safe for use in the EU. The Environmental Institute in Munich say that the chemical could have been carried into the beer through hops or the cereals which are part of the ingredients, pointing out that “large scale use of Glyphosate is a daily part of crop production” in Germany. The beers which were tested were on sale in German supermarkets in December 2015 and January 2016.

A 45-year-old woman in Germany has admitted to killing seven of eight toddlers, whose corpses were discovered at an apartment in the northeast Bavarian town of Wallenfells.
Local police in the Upper Franconia administrative region announced in a Saturday statement that the yet unidentified woman confessed to murdering the infants after discovery of their bodies led to her detention in a village late Friday.
The development came after the local police announced that they responded to a tip on Thursday by a resident who reported that there was an infant’s body inside the apartment.
However, when officers reported to the scene, they found several other bodies of small children wrapped in hand towels and placed in plastic bags.
Subsequently, a local judge issued an arrest warrant for the woman arrested on suspicion of seven counts of murder. Police added that they released a 55-year-old man accompanying the suspect without charge.
The authorities stated that forensic examinations of the corpses may take some time "due to the poor condition" of some bodies, with no result expected before early next week.
Investigators are yet to determine how the small children had died and who their father is.
This is while the major German daily Bild reported that a former resident of the apartment had lived there with her husband for 18 years, and that the couple had three children.
It further added that she also had four more children from other relationships, noting that she had tried to conceal her frequent pregnancies. The daily also cited an unnamed source as saying that the woman had gone through four miscarriages.

According to the newspaper, she moved out of the apartment in late September following a quarrel with her spouse. It added that she had spoken about hiding infant bodies at her apartment while drunk. The claim was overheard by a neighbor, who began looking for the bodies and informed police after she made the gruesome discovery.
Germany has been witnessing a number of similar cases in recent years. In May, a woman was sentenced to only 44 months in prison after murdering two of her children and then hiding their bodies in a freezer.
In October 2013, construction workers in Bavaria discovered the bodies of two infants, dead since the 1980s.
Also in 2008, a 42-year-old woman was convicted of murdering eight of her newborn babies and then concealing their corpses in buckets, flower pots, and an old fish tank.

It further added that she also had four more children from other relationships, noting that she had tried to conceal her frequent pregnancies. The daily also cited an unnamed source as saying that the woman had gone through four miscarriages.

According to the newspaper, she moved out of the apartment in late September following a quarrel with her spouse. It added that she had spoken about hiding infant bodies at her apartment while drunk. The claim was overheard by a neighbor, who began looking for the bodies and informed police after she made the gruesome discovery.
Germany has been witnessing a number of similar cases in recent years. In May, a woman was sentenced to only 44 months in prison after murdering two of her children and then hiding their bodies in a freezer.
In October 2013, construction workers in Bavaria discovered the bodies of two infants, dead since the 1980s.
Also in 2008, a 42-year-old woman was convicted of murdering eight of her newborn babies and then concealing their corpses in buckets, flower pots, and an old fish tank.
